Across the workforce, employer surveillance is growing increasingly common, even though it is widely disliked by employees. According to the American Psychological Association, employee monitoring increases workers’ stress and decreases their reported mental health. A Canadian study found that surveillance in the workplace makes employees feel more pressured, less satisfied with their job, and like their privacy is being violated.

AI may now make this problem worse. These negative outcomes are the consequences of more traditional surveillance methods like keyboard tracking and email monitoring. Considering that, what would the psychological impact be of learning that an employer will now use AI to take 160 photos of an employee’s face every day?

A recent New Jersey lawsuit alleges that an employer was trying to do just that, and fired its employee when she refused to agree to this monitoring. The plaintiff in this case, Glennis Von Sander-Timinski, worked for Sutherland Healthcare Solutions, which provides health care services outsourcing. The suit states that she had been working at home with no issues since 2018, and had achieved positive performance reviews during that time.

However, everything changed in August when her company told her that they would be using a new tool: Sentinel AI. This software would take a photo of her through her webcam about every three minutes over the course of the day, for a total of about 160 photos per day.

Von Sander-Timinski objected to this with the worry that it would increase her stress level, and therefore trigger her underlying lupus. According to the Lupus Foundation of America, stress can be a significant trigger of lupus flares, which can result in fevers, rashes, and sores. Her doctor wrote a note to her employer arguing that the facial AI monitoring should be changed to be “intermittent or less frequently, as it is causing worsening of anxiety and flaring her Systemic Lupus Erythematosus.”

However, Sutherland Healthcare was not willing to compromise and gave her an ultimatum. She could agree to the AI monitoring, come into the office every day, or be fired. Returning to the office was not feasible as she lives in Atlantic County, on the opposite side of New Jersey from her employer’s office in Clinton. The lawsuit estimated that her daily commute would have been a total of six hours long.

Therefore, on September 8, Von Sander-Timinski was fired. She had worked at Sutherland for over a decade, since it acquired the company she previously worked for in 2013.
